(12) Mode of succession of two or more heirs -Sec.19

     If two or more heirs succeed together to the property of an intestate they shall take the property -

  1. save as otherwise expressly provided in this Act per capita and not per stripes; and

  2. as tenants-in-common and not as joint tenants.


Simplified Version

(12) Mode of succession of two or more Successors:-Sec.19

     If two or more Successors succeed together, to the property of a person dying without will, shall      take the property :

    a.    in case of Class-I heirs as per strips.

             per strips: by stocks, i.e. the children of a deceased heir (the person who is entitled to            the property of the deceased person)shall take the share he would have had.

           in case of other heirs - per capita.

             per capita: individually, i.e. each heir will take a individual share.

    b.    If two or more Successors succeed together, to the property of a person dying without            will, shall take the property:  

           as defined and specified share; but not as joint tenants i.e. share which is not defined.
